For over twenty years, Jim has representednumerous major corporations in patent infringement litigation in a wide variety of industries, with a particular focus in the life sciences, i.e., the pharmaceutical, biotechnology andmedical device industries. In particular, Jim continuously since 1985 has litigated medical device patents, including those relating to blood glucose sensors, sutures, surgical staplers, trocar devices for laparoscopic surgery and coronary stents. Over the past several years, he has represented and counseled clients innumerouslitigation matters relating to monoclonal antibody technology and pharmaceuticals under the Hatch-Waxman Act. Throughout his career, Jim has tried cases and argued appeals in federal courts throughout the United States.His courtroom experience includes jury and bench trials, and evidentiary hearings relating to preliminary injunctions, inventorship and the construction of patent claims, i.e., "Markman" hearings. He has extensive experience in cases involving expedited relief, e.g., temporary restraining orders, preliminary injunctions and the seizure of records and infringing goods. In addition, Jim has provided testimony as a patent law expert witness based on his successful representation of United States Surgical Corporation in the landmark inventorship case, Ethicon, Inc. and InBae Yoon, M.D. vs. United States Surgical Corporation and Young Jae Choi, 135 F.3d 1456 (Fed. Cir. 1998). Jim was the principal architect of the unique strategy employed in that case. Jim has successfully represented a number of clients in federal court actions, as well as in the U.S. Patent and Trademark Office in cancellation and opposition proceedings, involving major corporate trademarks.
