Q. Can you sell something trademarked in a different good and service listed?

A: Yes, it is possible to sell something in completely unrelated goods and services. You need to get a comprehensive trademark search analysis on the proposed use of the trademark. The trademark attorney needs to analyze your proposed use of the trademark with everything in the market including USPTO database, state databases, common law search, etc.

However, assume that you may probably get a cease and desist letter from the trademark owner about the use of the mark. Sometimes, trademark owners and attorneys aggressively use cease and desist letters to stop any use even unrelated. Legally they can't stop unrelated use and there is no likelihood of confusion. You also need to factor in whether this is all worth it considering the legal cost associated with responding to cease and desist letters. Therefore, please consider doing a self-evaluation of your economic resources, capabilities and the need to use that particular mark.

Q. Can we use the term 'Craigslist' in a title for a tv show concept?

A: You cannot use "craigslist" in a title for TV show concept. Craigslist website is an established and well-known website for advertising goods and services. You may cause costumer confusion as to the "association" of the brand craigslist. Creating false association is a violation of lanham act. If you want further analysis, you can hire an intellectual property attorney. Once your TV show gets publicized with "craigslist" word in it, you will most probably get sued. Risk is too high for this type of association with a well-known brand with out any license.

Q. can i sell a brand name which there was a trademark name which was abandoned ( status 605 ) regards

A: Trademark abandonment only deals with USPTO federal trademark database. Depending on each individual trademark abandonment case, and the nature of the abandonment such as failure to respond, renew, or any unforeseen circumstance etc may impact rights. There may be some rights left over depending on the date of abandonment. They may still have superior common law rights in the geographical region, registration in the state database etc. Consult any trademark attorney that may help you with your needs.
