Ben co-founded Volpe Law in 2020 to take his knowledge and experience in civil litigation and apply it in a local firm setting with accessibility to members of the community and local/regional businesses. Ben enjoys serving clients in both transactional and litigation matters. Some of the areas of law Ben and his firm excel in are construction litigation, liens, real estate disputes, business/partnership disputes, tort litigation, commercial litigation, leasing, and insurance. Ben and his attorneys enjoy helping their clients mitigate litigation risk through strong contract drafting and legal counsel on laws affecting clients and their businesses.
Prior to founding Volpe Law, Ben worked for an insurance defense and construction litigation law firm in Denver, Colorado, where his practice focused on construction defect litigation, breach of warranty and builder disputes, business/commercial litigation, and multi-state complex general casualty litigation.
While attending law school, Ben felt strongly that practical legal experience and career experience were more important than the trivial classroom politics, push towards competition and rankings, and theoretical lectures. Most of it benefits the law school and not the students. Ben is a strong and capable lawyer today because of his focus on strong legal analysis, legal writing, client relations, and courtroom skills.
Prior to law school, Ben worked in both local and federal investigations and law enforcement.
Ben has a Juris Doctor degree from The Catholic University of America, Columbus School of Law, a Master's Degree from The George Washington University, and a Bachelor's Degree in Criminal Justice.

- Q. How to replace a boundary fence without neighbors permission in Colorado
- A: I'd double check all the HOA governing documents that speak to fences. If it is up to your neighbor and you to maintain, repair, and replace the fence as a shared fence, you will have to try to work with them. This can be difficult with contentious neighbors. No matter what you do, there's a good chance you will be sued in a fence/boundary dispute or you will sue your neighbor. So, consider whether doing a fence replacement without permission could end up in a huge financial loss to you if it is disputed and ends up in litigation anyway. - Q. Contractor purchased materials on my CC, most never delivered/installed, he disappeared after demo, what is my recourse?
- A: I suggest considering a demand letter to the contractor regarding the issues. Keep in mind if there are construction defect issues, you'll need to consider a notice of claim letter per the Construction Defect Action Reform Act. If they do not make an effort to resolve the situation, you may be facing the need to file a lawsuit. Without a copy of the contract, it's difficult to say if you are required to mediate and/or arbitrate. Another thing that could result here is they could record a mechanic's lien on your house. If that happens, you should be put on 10-day notice of that lien filing via mail prior to the lien being filed. This dispute needs to be addressed properly. You would ... Read More
