Q. I have a question can dui's that are nine years old be used against me in court?
A: It depends. DUI's within 7 years can enhance your sentencing in DUI cases. In some instances, felony DUI's (or felonies in general) may be used against you if you testify in a court case. So, more information is needed to better answer your question.
Q. From your experience what might be a judge verdict of first time offense possession LT 2lbs and possession of parap...
A: You may be eligible for a diversion program.
Q. Police search a car that was not mines and charge me they say i committed the crime on a date i did not what happens
A: More facts are needed to answer this question. Were you driving the car, did you admit, what are your charges, criminal history, etc.?
Q. I received a criminal speeding ticket, but have no prior record/tickets. Is it likely a judge won't convict me?
A: It depends on the facts, namely your speed. You may be able to get Defensive Driving School.
Q. If you are in your own home and someone is assaulting you do you have a right to fight back?
A: In Arizona, people are justified in using physical force when a reasonable person in the same situation would believe it necessary to use such force to protect against an immediate threat. The law does not authorize unlimited force, just the force a reasonable person would believe necessary to protect against an immediate threat. In other words, if someone punches you, it's likely not reasonable if you defended yourself by shooting that person.
Q. Can you get a DUI if you were pulled over for something else?
A: Yes. Often times an officer will pull someone over for a traffic violation etc. and upon contact, determine the person may have been drinking. At that point, a DUI investigation may ensue. If the officer determines there is probable cause for the DUI, the person will likely be arrested.
Q. Can you transfer court ordered DV classes from CA TO AZ and complete them in AZ
A: You would likely have to get approval from the CA court and prosecutor, as well as find a similar program in AZ that would accept you and fill the CA requirements. You could talk to a CA defense attorney for a more informed answer re:CA processes.
Q. 28-3473 Suspension. Lic. A I have my Lic. Reinstated already.. what should I do with this ticket
A: Show your reinstated license to the Court.
Q. How can I file domestic violence and sexual assault on someone when offense was 6yrs ago.
A: You can contact the police in the jurisdiction where the offenses occurred. File a police report and they will investigate re: any possible charges.
