A man that truly loves helping people. I was literally brought to tears. I'm not going into details but, I'm glad he picked up the phone. Very competent and fiercely loyal. I have nothing but praise for Mr. Berschler. He was professional, personable, and a very good listener. If he takes your case, you won't find a better "pit bull" working hard on your behalf. He answered all of my questions, never left me hanging, took my calls or promptly got back to me. During depositions, he made me feel confident and sure of myself and the merits of my case. When discussing settlement offers, he was very good at explaining the consequences of either accepting or rejecting an offer. I came away from the process feeling that justice had been done better than I had expected and that I had been lucky to have him on my side.

Represents clients whether they be injured at sea or be victims of personal injury or wrongful death accidents ashore, or vessel owners-operators.
He has contributed to the development of case law applicable to vessel-side personnel under Title VII, the Civil Rights Act of 1866 (42 U.S.C., §§1981; et seq;) the Civil Rights Act of 1964, amended in 1991 (42 U.S.C., §§ 2000e; et seq.)

Q. I paid $12,000 to a broker for sailboat. I am now being told that the boat is for sale “as is” by owner” is this legal?
A: First, I apologize for the delay; just back from vacation.

SECOND: Depends on which state the transaction took place. For instance, if in California, the answer would be “no.” An “as is sale” must be clearly stated in writing. Attorney fees might be recoverable.
Q. Son was severely physically disabled for life due to antioch cps. Do i have a case?
A: Sounds like your son was severely by police in Antioch. If so, your son - not you has the right to bring a claim or suit. If your son is a minor child (less than 18byerars) you or another adult would be bringing the claim as your son's "guardian ad litem": an adult responsible to your son.
Q. What is the time limit to serve a PI lawsuit in state of California in this pandemic situation?
A: California Rule of Court, 3.110(b) provides:

The complaint must be served on all named defendants and proofs of service on those defendants must be filed

with the court within 60 days after the filing of the complaint. When the complaint is amended to add a

defendant, the added defendant must be served and proof of service must be filed within 30 days after the filing

of the amended complaint.

As a practical matter that I have seen in 46 years of practice, Court court will grant more time than 60 days. Woody Allen once said, "90% of success is just showing up." the point being that the plaintiff or plaintiff attorney best appear for all court appearances, especially to explain why it is taking longer than the Rule allows to serve the defendant. ...
