- A: Under the Family Code, child support is determined based on the parents' income, percentage of time with each parent and certain deductions which are allowed in calculating the amount of child support. If you have a previous child support order and there are change of income and/or custodial time, then you may file for modification of child support. - A: As long as the California Court has jurisdiction over the minor child then, you will be able file a Request for Order with accompanying documents and get a court order to enforce custody rights.
