Biography

Ravenna Attorney Andrew Popp focuses on two fields of law: Elder Law and Estate Planning. He is results-oriented, relying on his exceptional legal knowledge and successful litigation techniques to achieve results.

Andrew obtained his bachelor’s degree from the University of South Florida. He then attended Stetson Law School, where he acquired his Juris Doctor with a concentration in advocacy.

While at Stetson, he received numerous awards, including the Doyle Conflict Resolution Inc. Top Grade Award and the Leadership Development certificate.

Upon graduation, Andrew served as an Assistant State Attorney. He handled criminal cases from initial investigation through trial and appeals and prosecuted hundreds of misdemeanor and felony cases. He gained extensive first and second chair trial experience in both bench and jury trials.

After leaving the prosecutor’s office, Andrew decided to dedicate his career to assisting clients with Elder Law Issues. Motivated by his passion for defending his clients’ interests, he acquired an in-depth knowledge of wills, trusts, probate, estates, and Medicaid planning.

Andrew is well versed in the various techniques available to protect his client’s assets from being taken away upon entering a nursing home.

He has seen far too many examples where families have waited too long to set their affairs in order, and the damage it can cause. He provides Portage County residents with advice on proper planning concerning their hard-earned assets.

Q. So my stepgrandmother got the property when my grandfather died and my dad has been living there for over 30 years
A: It all depends on how title to the property is held, how your grandfather's wishes were memorialized. You need to sit down with an attorney so he or she can take a detailed look at the entire situation and provide some guidance. Best of luck.
Q. How can I gain access to my mothers bank account now that she is deceased?
A: Unless the account was set to pay on death to a beneficiary, then the only way to access those funds is by going through the probate process. The process can be complex, although as Mr. Jaap said, there are occasions when a simplified process can be used. If you want to try doing it yourself I suggest: 1. Review Ohio's Rules of Superintendence https://www.supremecourt.ohio.gov/LegalResources/Rules/superintendence/Superintendence.pdf 2. Review the local rules. (Probate should be opened in the County Probate Court where your mother lived at the time they passed away) 3. Go to your local law library and do some research. They typically have legal treatises that can help provide some guidance. Keep in mind that depending on how title is held, you may be required to open up a probate for your mother, AND a separate one for your father. Best of luck.
Q. The officer would not take my wife's statement of what she witnessed because she is my spouse. Is the officer correct?
A: How an investigation proceeds is to a certain extent up to the discretion of the investigating officer. While there can certainly be arguments about partiality, if your wife witnessed the incident then she may be called upon to testify later. (Either as a defense or prosecution's witness). Speak with your defense attorney. They may want to interview her sooner rather than later to document her observations.
