Summary

Attorney Andrew Hughes has over 17 years of experience in the fields of railroad, trucking and toxic torts. He has litigated and tried cases against the Midwest’s top toxic tort and transportation attorneys. Andrew focuses his drive on helping workers suffering from diseases such as cancer and leukemia following long term exposures to diesel exhaust. Andrew founded Chicago-based Hughes Law Offices LLC dba Diesel Injury Law. His firm fights for workers sickened by diesel exhaust while working in all occupations where prolonged exposure to diesel exhaust occurs, including the railroad, trucking, construction, mining, firefighting and maritime industries. Diesel exposed workers are often exposed to other toxins such as welding fumes, silica, asbestos, creosote and products that contain benzene. Diesel Injury Law takes all those exposures into account when consulting with experts and determining the causes of the illness at hand.

Q. My Dad worked for the railroad and now has lung cancer. He worked around diesel exhaust. Can he sue the railroad?
A: Yes - if he was exposed to diesel exhaust at work he may very well have a case. Diesel Exhaust is now considered a carcinogen by the World Health Organization. He would need to bring his action under the Federal Employers Liability Act. If he rode on locomotives, the Locomotive Inspection Act and Code of Federal Regulations will come into play as well. These are complicated toxic tort claims however, so make sure that you retain counsel who is very familiar with both FELA law and toxic tort litigation. Multiple experts will need to be retained in order to prove up a claim like this. Best of luck to you.
