Alan Harrison is a mechanical and nuclear engineer who served as an officer in the United States Navy Submarine Force before becoming an attorney. He has practiced as an attorney since 2010, and addresses clients' legal matters with diligence and precision. Q. Can I sell products under "Reaper Golf" with a pending trademark conflict?
A: I'm currently handling a similar situation for a client who had been selling product for more than four years when a newcomer filed a trade mark application last year on the identical mark and similar product. This lead to at least a trade mark opposition: https://ttabvue.uspto.gov/ttabvue/v?pno=91297520&pty=OPP&eno=1. There are options, as the senior user, to protect your trade mark.
Q. How can I copyright my unique jewelry designs in the US?
A: You could be eligible for copyright protection and design patent protection on the individual designs, and possibly also utility patent protection on the method of wrapping the wires (depending how long you've been doing it or if or when you published the videos).
Q. Does "Nuke Town Skate Co." infringe Activision's "Nuketown" map rights?
A: A court would consider several factors when assessing whether your proposed use of "Nuke Town Skate Co." might infringe on Activision's NUKETOWN name. First would be whether NUKETOWN, as used by Activision, actually functions as a trade mark, i.e. an identifier of Activision as the source of a game or other good or service. Then whether NUKETOWN has been registered. Then whether NUKETOWN still is being used by Activision. There are about eleven other factors (in Connecticut New York Vermont, anyway).
