Mr. Tomas has tried over 100 jury trials and has secured acquittals for clients charged with capital murder, non-capital murder, racketeering, federal crimes, attempted murder, robbery, burglary, and battery. He has also successfully obtained favorable results for his clients without having to go to trial and has secured pre-trial dismissal of charges such as murder, rape, manslaughter, tax evasion, kidnapping, drug trafficking, and DUI.

Mr. Tomas is Board Certified by the Florida bar as an expert in both Tax Law and Criminal Trial Law. He is the only attorney in entire state of Florida with both these designations. He is also aboard Certified in Criminal Trial Law by the National Board of Trial Advocacy. Mr. Tomas is also one of a very few select attorneys in the state who is "death certified" which means he is qualified to accept court appointments to represent defendants who are facing the death penalty.

Mr. Tomas handles a full range of criminal defense issues, such as white collar crimes, capital felonies, DUI, sex offenses, murder and grand jury representation. He represents clients on various tax issues, including employment and payroll, tax collections, IRS liens and seizures, offshore compliance, voluntary disclosures and civil tax controversies. He also regularly counsels clients on the subjects of trust and estate planning, general tax planning and corporate structuring.

A: There are no set guidelines or elements, but rather there is a procedure when competency is an issue. Pursuant to Florida Rules of Criminal Procedure Rule 3.210(b): If, at any material stage of a criminal proceeding, the court of its own motion, or on motion of counsel for the defendant or for the state, has reasonable ground to believe that the defendant is not mentally competent to proceed, the court shall immediately enter its order setting a time for a hearing to determine the defendant’s mental condition, which shall be held no later than 20 days after the date of the filing of the motion, and may order the defendant to be examined by no more than 3 experts, as needed, prior to the date of the hearing.
