Mr. Evans concentrates his practice in commercial litigation, labor and employment litigation, and education law. His commercial litigation practice includes the representation of a variety of business clients regarding contractual disputes, injunctive relief, matters raising questions of constitutional due process, regulatory compliance, labor and employment issues, as well as risk management. Mr. Evans also represents a number of insurance carriers concerning coverage and compliance issues. He also provides extensive litigation support to utility clients concerning regulatory matters, including issues regarding compliance with the New York Public Service Law, the regulations of the New York Public Service Commission, and Utility Tariffs. He has represented a number of educational institutions regarding matters pertaining to disabled students, student discipline, constitutional law, labor and employment issues, regulatory compliance, collective-bargaining and labor arbitration, construction litigation, and several other areas, complimented by the firm’s full Practice Groups. Doug Zamelis has over 21 years of experience counseling and representing corporate, governmental and individual clients in compliance and litigation matters involving open government and our shared environment.

In addition to his Juris Doctor from the Syracuse University College of Law (1989), Doug holds a B.S from Cornell University (1986)and a M.S. from the SUNY College of Environmental Science and Forestry (1989). Doug brings his extensive scientific knowledge and experience to bear on behalf of clients in federal matters involving the Clean Water Act, the Clean Air Act, the Resource Conservation and Recovery Act, the Comprehensive Environmental Response, Compensation and Liability Act, the Emergency Planning and Community Right to Know Act, the Toxic Substances Control Act, and the Occupational Safety and Health Act, and in New York matters involving the New York Environmental Conservation Law, Navigation Law, and Public Health Law. Doug also represents clients in environmental, land use, zoning, and municipal matters before New York state courts and agencies including the state Supreme Court, the Appellate Division, the Court of Appeals, the Office of the New York Attorney General, the New York State Department of Environmental Conservation, the New York State Department of Health, the New York State Department of Labor, the Empire State Development Corporation, and the Adirondack Park Agency.

Doug has successfully litigated numerous Article 78 proceedings in New York courts, and has litigated with opponents including the State of New York, Pyramid Corporation, Wal-Mart, Iberdrola, Astra-Zeneca, and National Grid. His litigation experience also includes numerous cost recovery and defense actions in hazardous substance and oil spill matters.

Doug counseled the Metropolitan Development Association of Syracuse and Central New York in the negotiation and acquisition of Electronics Park from Lockheed Martin Corporation. Electronics Park is presently a showcase model for redevelopment of environmentally impacted properties.

Doug has extensive experience throughout New York State representing various applicants, reviewing agencies, and stakeholders in complex and controversial land use matters involving reviews pursuant to local zoning laws,the National Environmental Policy Act, and the State Environmental Quality Review Act. Representative projects include electrical generating and transmission facilities, hazardous waste facilities, large scale retail, manufacturing, and consolidated and unconsolidated mining operations. Doug represented the petitioners in Matter of Brander et al. v. Town Board of the Town of Warren, l18 Misc. 3d 477, 847 N.Y.S.2d 450, 2007 N.Y. Misc. LEXIS 8258, 2007 NY Slip Op 27498 (Sup. Ct. Onondaga Cty 2007) (uncorrected opinion) wherein the New York State Supreme Court anulled the approvals for an 80 turbine wind power generating facility in Southern Herkimer County based on the reviewing towns' failure to properly review the project pursuant to the State Environmental Quality Review Act. The court also granted the petitioners their attorneys' fees for successfully prosecuting their claims that the reviewing towns violated the state Open Meetings Law. The decision was not appealed.

Doug represented COR Development in its litigation with Pyramid Corporation concerning COR Development's Towne Center at Watertown, and authored COR Development's successful motion for leave to appeal to the New York Court of Appeals. Towne Center at Watertown is now a bustling and productive shopping destination.

Doug represented the Otsego Electric Cooperative, Inc. in the multi-jurisdictional local land use review and environmental permitting of an approximately 7 mile electrical transmission line and associated point of delivery and substation facilities in the Towns of Laurens and Oneonta in southern Otsego County. The transmission line currently serves the rural electric cooperative's customers in that area and improves service to the cooperative's other members.

Access to governmental records is integral to Doug's practice and he has extensive experience in matters involving the New York Freedom of Information Law and Open Meetings Law. In addition to recovering his clients' attorney's fees in Matter of Brander et al. for violations of the Open Meetings Law, Doug also represented Petitioner Patricia Ehrich who prevailed in her Article 78 proceeding against New Roots Charter School of Ithaca New York where the Madison County Supreme Court found that the school had violated the Freedom of Information Law and Open Meetings Law. In addition to awarding Ms. Ehrich her attorney's fees for prosecuting her FOIL claims, the court ordered that the school's Board of Directors, executive staff and records access officer attend FOIL and OML training by the New York State Department of State Committee on Open government staff. A successful "government in the sunshine" lawyer, Doug is the only practicing attorney in New York who has successfully recovered attorney's fees for clients for violations of both the Freedom of Information Law and Open Meetings Law, and to obtain an order requiring an agency to attend FOIL and OML training.

Prior to entering the private practice of law, Doug was employed by the New York State Department of Environmental Conservation in the Division of Water at the Region 7 Headquarters in Syracuse where he became familiar with the inner workings of the agency and its various Bureaus and Divisions. Doug was later an associate attorney at Jacobowitz & Gubits, Walden, New York, and then an associate and partner at Hancock & Estabrook, LLP. Syracuse, New York. Doug then joined Green & Siefter, PLLC Syracuse, New York and taught law as a Visiting Assistant Professor at the Syracuse University College of Law before starting the Law Office of Douglas H. Zamelis in 2007.

Doug is the former Chair of the Environmental Law Section of the Onondaga County Bar Association and currently serves as Co-Chair of the Petroleum Spills Committee of the Environmental Law Section of the New York State Bar Association.

JIM BARNA BRINGS A WEALTH OF EXPERIENCE TO EMPLOYMENT LAW REPRESENTATION.

Throughout his career, Jim Barna has focused his practice on employment law.

"When I was young, I always knew that my future was in the law; and from the time I entered law school, I knew that employment law would be where I would focus my practice.â"

Jim did his undergraduate studies at Syracuse University and Stony Brook University.

Jim attended law school at Washington University in St. Louis, a Top Twenty law school with an extensive employment law curriculum. In law school in St. Louis, Missouri, Jim had a number of experiences that paved the way to his career litigating employment law cases.

"It started with a law school faculty of committed litigators who were recognized employment law authorities. From them I learned to navigate the complicated regulatory framework of federal and state employment laws. I was very interested in employment law, and I earned high marks in all my employment law classes."

During law school, Jim interned with a Federal judge. "This allowed me to see the litigation process from 'behind the bench,' so to speak, which gave me insight into the motivations of judges and juries in the legal process.â"

As a first year law student, Jim won a legal writing contest that resulted in his first scholarly article being published by the law school. The article dealt with an employment law topic: Keeping the Boss at Bay â Post-Termination Retaliation Under Title VII: Charlton v. Paramus Board of Education, 25 F.3d 194 (3d Cir. 1994), 47 Wash. U. J. Urb. & Contemp. L. 259 (1995). Jim had two scholarly articles published while he was in law school, which was a significant achievement. Jim went on to become the Articles Editor of the law review, and edited several law review articles related to employment law.

While Jim was in law school, he had the opportunity to work for a national leader in employment law and womenâs rights litigation, Mary Anne Sedey. âFrom Mary Anne Sedey, I saw that big cases can bring big changes, and that a life devoted to seeking justice can coincide with success for clients and attorneys.â

After he graduated from law school in 1996, Jim spent ten years working for nationally recognized employment law firms in Memphis, Tennessee, a center of labor and employment law work. During that time, he handled litigation matters in 22 states, and the District of Columbia.

In 2002, Jim was associate counsel, and coauthor of the victorious merits brief, in the first Family and Medical Leave Act (FMLA) case to be heard by the United States Supreme Court, Ragsdale v. Wolverine World Wide, Inc., 535 U.S. 81 (2002). He is a member of the Bar of the United States Supreme Court.

Jim is holds law licenses in New York, Maine, Tennessee, and Mississippi.

Throughout his career, Jim has continued to litigate significant employment law cases, and he continues to speak and write about developing employment law topics.

"One of my first cases in New York involved a former employee of a specialty chemicals company who had been terminated after developing bipolar disorder and becoming unable to work. The company had complied with the legal requirements before terminating him, so there was no claim for disability discrimination. After interviewing the client, I discovered that for years the company had failed to pay him overtime, and that he was owed a large amount of money in unpaid compensation. Until I informed him of this, the client did not know that he was entitled to overtime. I brought a lawsuit in Federal court on his behalf, and I was quickly able to negotiate a settlement that put him in a much more positive financial footing. Sometimes to find justice you need to uncover claims and theories that arenât apparent at first."

George Hildebrandt has substantial successful trial experience. For over 25 years, he has represented clients in federal and state courts in drug conspiracy and smuggling, murder, white collar, firearm and other serious cases, achieving many acquittals, dismissals and convictions for greatly reduced charges. George has built his reputation on his hard work, preparation and knowledge of the law.
