He currently serves as a "Building" attorney, whose primary objective is preparing petitions for clients filing for relief under Chapters 7 and 13 of Title 11 of the United States Code. John J. Forbes joined Robert J. Semrad & Associates, L.L.C. in early 2011 and is an associate in the downtown Atlanta Office. Mr. Forbes has been practicing bankruptcy law since 2009. He received a J.D. from the Georgia State University College of Law in May 2009. While in law school, Mr. Forbes interned at the United States Trustee’s Office, the part of the Department of Justice that oversees the administration of bankruptcy cases. He received his undergraduate degree from Boston College where he earned a B.A. in Economics. He earned his Master of Business Administration degree at the University of Pittsburgh. Mr. Forbes spent more than a decade in the marketing department of a large media corporation prior to becoming a lawyer. He is a native of Philadelphia, PA and the father of three. Kristi Smith joined Robert J. Semrad & Associates in March 2010 and since that time, has worked as an associate in the Atlanta office on both Chapter 13 and Chapter 7 cases. Currently, she handles all Chapter 13 matters before the Honorable Mary Grace Diehl. Prior to joining the firm, she served as an intern with the United States Trustee Program. Brian Zeft is the supervising attorney for the Firm's Illinois offices. Mr. Zeft is a member of both the Firm’s bankruptcy and litigation departments. While at the Firm, Mr. Zeft has twice argued in front of the United States Court Of Appeals for the Seventh Circuit. One decision successfully overturned long standing Seventh Circuit precedent, resulting in new law requiring secured creditors to immediately return property of the bankruptcy estate to the debtor without the need to file an adversary proceeding. See Thompson v. General Motor Acceptance Corp., 566 F.3d 699 (7th Cir. 2009). ??Prior to joining the Firm, Mr. Zeft graduated cum laude from The John Marshall Law School, where he was a member of The John Marshall Law Review. While attending John Marshall Law School, Mr. Zeft was an extern for the Honorable Alexander B. White for the Circuit Court of Cook County.

Prior to attending John Marshall Law School, Mr. Zeft worked for a Wall St. investment bank. Mr. Zeft attained a Bachelor of Science in Business Administration in 2001 from Rider University in Lawrenceville, NJ. Mr. Zeft was born and raised in Philadelphia, PA before moving to Chicago to attend law school.

Mike Miller is an attorney for the firm’s office in Aurora. Mr. Miller joined Robert J. Semrad and Associates in 2004 as a law clerk, and then became an Associate Attorney in 2006.

Prior to joining the firm, Mr. Miller graduated with Honors from Roosevelt University with a Bachelors of Science in Business Administration, with an emphasis in Management, in 2001.

Mr. Miller then went on to receive his Juris Doctorate from The John Marshall Law School in 2005. While in law school, Mr. Miller was an extern with the United States Department of Justice’s Office. In addition, Mr. Miller also was an extern at the Greater Southwest Development Predatory Lending Clinic, helping consumers against predatory lending practices.

Robert Mick is an associate attorney at the Firm’s Joliet office. Mr. Mick is a member of the Firm’s bankruptcy department where he handles all bankruptcy matters for clients in the collar counties of Will, Kendall, Grundy, and LaSalle. While at the Firm, Mr. Mick has advised and consulted hundreds of clients at both the Joliet and South Side Chicago offices in addition to preparing and filing their bankruptcy petitions.

Prior to joining the Firm, Mr. Mick graduated from The John Marshall Law School. While attending The John Marshall Law School, Mr. Mick was a law clerk for the Illinois Office of the Attorney General, Lisa Madigan, in their special litigation and civil rights divisions, as well as a law clerk for the firm of Pissetzky & Berliner where he practiced in both criminal defense and real estate. After graduating from The John Marshall Law School, Mr. Mick continued to work for Pissetzky & Berliner as a short sale negotiator, as well as a volunteer legal advisor for the Chicago Legal Clinic where he advised homeowners facing foreclosure at the Daley Center’s Chancery Help Desk.

Mr. Lentner joined the firm in 2007 after graduating from the University of Dayton School of law. Mr. Lentner has overseen the firms Will County office and cases as well as the firms office on Western Ave. in Chicago.

Prior to joining the firm Mr. Lentner worked in the law department of an Ohio municipality, and also for United States Senator Charles Grassley.

Robert Schwaba is an associate attorney for the Firm's Illinois Chicago Loop office. Mr. Schwaba is a member of both the Firm's bankruptcy and litigation departments.

Mr. Schwaba has been employed as an associate attorney at the Firm since graduating from Loyola University Chicago School of Law. In the course of his employment at the Firm he has drafted appellate briefs for the United States Court of Appeals for the Seventh Circuit, as well as a brief for an appeal to the Northern District of Illinois and numerous briefs in other bankruptcy matters.

Marisa Leeds joined Robert J. Semrad & Associates in August of 2008 and is an associate in the Atlanta office. Ms. Leeds has been practicing bankruptcy law since joining the firm. Previously Ms. Leeds spent two years as a court attorney, handling all the various matters involved with Chapter 13 bankruptcies and representing clients in court in defense of their Chapter 13 bankruptcy cases and plans. She currently primarily meets with new clients for consultations and supervises the attorneys and paralegals who file cases for new clients. Ms. Leeds received a J.D. from Georgia State University College of Law in May 2008. Sexual Harassment:

Sexual harassment, like other forms of discrimination or harassment on the basis of race, national origin, age, or disability, is barred by a federal law called Title VII. http://www.eeoc.gov/policy/vii.html Title VII applies to employers with 15 or more employees, including state and local governments. It also applies to employment agencies and to labor organizations, as well as to the federal government. Examples of sexual harassment include unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature constitute sexual harassment when this conduct explicitly or implicitly affects an individual's employment, unreasonably interferes with an individual's work performance, or creates an intimidating, hostile, or offensive work environment. There are two basic types of sexual harassment. The first type of sexual harassment is called Hostile work environment sexual harassment. This form of harassment occurs where an employee, because of his or her gender, is subjected to an atmosphere of unwelcome conduct (this can be words or actions) that unreasonably interferes with the employee's work performance or otherwise creates an intimidating, hostile, or offensive work environment.

The second form of sexual harassment is called quid pro quo sexual harassment. This form of sexual harassment occurs where an employee is required to submit to unwelcome sexual conduct as a condition of his or her employment, or in order to gain some tangible job benefit. For instance, if a superior demands that you have sex with him in order to be considered for a promotion then he would be guilty of quid pro quo sexual harassment.

Generally, in order to violate the law, the sexual harassing behavior must establish certain criteria. First, the sexual harassment must be unwelcome and offensive to the complaining party/employee. Therefore, if the complaining party/employee has participated in telling the sexual jokes that she is complaining about or has engaged in a consensual sexual relationship with the co-worker she is complaining about, this evidence will be used by the employer to argue that the harassment was welcome. Second, the complaining party/employee must show that the employer knew or should have known of the sexual harassment. This does not mean that the complaining party/employee must have complained about the sexual harassment in order to recover. For example if the harassment occurred to others employees in the past or the harassment occurred in front of supervisors. etc. that may be sufficient notice to the employer. Third, the employer must establish that after the employer knew or should have known of the sexual harassment, they failed to take prompt remedial action.

Lastly, it is illegal for an employer to retaliate against a complaining party/employee for bringing a complaint or legal claim of sexual harassment, just as it is illegal for the harasser to retaliate against the employee.

Race Discrimination:

Race Discrimination like other forms of discrimination or harassment is barred two federal laws, Title VII http://www.eeoc.gov/policy/vii.html and 42 USC 1981. These laws make it illegal for employers, including state and local governments to make employment decisions on the basis of an individual's race. Race discrimination can include: racial harassment, failure to hire or promote, creation of a racially hostile work environment, and/or termination due to race.

Harassment:
Federal law prohibits offensive conduct, such as racial or ethnic slurs, racial "jokes," derogatory comments, or other verbal or physical conduct based on an individual's race/color. The conduct has to be unwelcome and offensive, and has to be severe or pervasive. Employers are required to take appropriate steps to prevent and correct unlawful harassment.

Federal Law prohibits discrimination in compensation and other terms, conditions, and privileges of employment. Attorney J. Stephen Mixon, Esq. is a graduate from Oxford College and Emory University (1989), in Atlanta, GA, and the University of Georgia School of Law (1992) in Athens, GA. Upon graduation, Mr. Mixon served as a staff attorney for the Honorable Senator Strom Thurmond of the State of South Carolina . Mr. Mixon then served as the Law Clerk for the Honorable Deborah Benefield on the Superior Court in Clayton County . Upon completion of his clerkship, Mr. Mixon was hired by the law firm Foster & Foster, PC where he represented Clayton County, Georgia, the city of Riverdale and other municipalities as well as many of Georgia's largest corporations such as Georgia Power in lawsuits throughout metro Atlanta , and our federal courts.
