I was a Deputy District Attorney for over 12 years prior to becoming a criminal defense attorney. I worked in Tulare and Orange Counties, prosecuting every type of criminal case, including driving under the influence, theft, three strikes, domestic violence, gang cases and homicides. I spent six years in the prosecution of serious sexual assault cases. For over a year, I worked closely with law enforcement in a narcotics task force assignment. That assignment included extensive work on search warrants and wiretap cases. I believe I have earned the respect of my colleagues in the District Attorney’s Office as well as with the judges I have appeared before. I have handled thousands of cases during all stages of criminal prosecution – from case assessment and the filing of criminal charges to trial and sentencing.

Before attending law school, I worked for over three years as a reserve Deputy Sheriff with the Los Angeles County Sheriff’s Department. During that time, I worked uniformed patrol and was involved in all aspects of criminal investigation, from traffic stops to bank robberies and homicide cases. During my time in the academy, I received honors as the top cadet in academics and firearms. I was also given the highest award and named Honor Cadet by the Sheriff’s Department.

In addition to being a trial lawyer, I have taught extensively on many aspects of the law. I currently teach all areas of criminal law at a state-approved police academy, including courses on search and seizure law, criminal interrogation and the laws of arrest. I also teach a course on homicide investigation at a local community college. I have trained other prosecutors during seminars for the California District Attorney’s Association (CDAA) in the areas of trial tactics and crimes against children.

After leaving the DA’s office, I opened my own practice, focused exclusively on criminal defense. As a solo practitioner, every client gets my personal representation - not a junior associate or an attorney unfamiliar with the facts.

Ms. Benedict grew up in San Diego, California. Throughout her childhood and into her adult life, Ms. Benedict has been an avid athlete. Her passion for athletics has shaped Ms. Benedict's life and approach to the practice of law.

Ms. Benedict completed her undergraduate studies at the University of California, Santa Barbara and received her law degree from the University of San Diego School of Law.

While Ms. Benedict was attending law school, she worked for the non-profit appellate law firm, Appellate Defenders, Inc. (ADI.) ADI administers the appointed counsel system in the Fourth Appellate District for indigent defendants on appeal. As a clerk at ADI, Ms. Benedict received extensive training in appellate brief writing. Upon graduating from law school, Ms. Benedict stayed on at ADI as a staff attorney. During her time as a staff attorney at ADI, Ms. Benedict represented in excess of 100 clients on appeal and presented numerous arguments at the Court of Appeal and three appearances at the California Supreme Court. Additionally, Ms. Benedict supervised the work of other appellate practitioners appointed to represent defendants on appeal.

In the summer of 2005, Ms. Benedict opened her own private practice. The focus of Ms. Benedict's practice remains appellate representation, both civil and criminal, as well as providing legal research and writing services to trial attorneys. However, Ms. Benedict's passion for athletes and her joy of cycling, led to the deveoplement of a niche practice of representing cyclists who have been injured.

After successfully running her own practice, Ms. Benedict joined the incredible team at Klinedinst, PC. At Klinedinst, PC, Ms. Benedict is a member of the general litigation and appellate practice groups.

Ms. Benedict is an experienced appellate advocate, representing clients before the California Court of Appeal, the California Supreme Court, the U.S. Court of Appeals for the Ninth Circuit, and the United States Supreme Court. To date, she has handled over 200 appellate briefs, in a wide range of matters including maritime, white collar crime, and corporate law. We handle a wide range of issues involving business, government contracts and public contracts, real estate, condominiums, commercial and residential property, construction, and construction defects, including:

* Construction defects actions. We work with owners, contractors, subcontractors, expert witnesses, and insurers in cases involving allegations of construction defects, including water leakage or damage, plumbing or roofing defects, structural problems or claims concerning other damage to buildings or other defects.

* Public works contracts and Government contracts, claims and disputes. We represent clients in legal actions related to local, state and federal government public construction contracts.
We handle bid protests, payment or performance disputes, stop notice and bond claims, Miller Act Claims delay or extra work claims, collections and disagreements involving unforeseen site issues and other delays, subcontracts, listing law requirements, and all other public works disputes.

* Construction contracts, claims, disputes and litigation. We represent contractors, subcontractors, and property owners in disputes involving construction contracts and subcontracts, payment and extra work disputes improper or inadequate construction plans, interference in the project, scheduling issues or unknown Site conditions that result in additional expenses and costs, and all other manner of related claims or disputes.

* Real estate contracts, property disputes, and litigation. We represent buyers, sellers and owners of residential or commercial property and condominiums in litigation involving purchase/sale contracts, construction issues, failure to disclose matters, real estate fraud, CC&Rs, water rights, encroachment, boundary line and survey disputes, easements and title disputes and similar matters.

Jerod Gunsberg represents clients in all California state and federal criminal matters, from first time misdemeanors to violent offenses to complex white collar matters. Mr. Gunsberg graduated from New York University where he was a University Honors Scholar. He received his law degree from Loyola Law School where he received First Honors in Trial Advocacy. After passing the California Bar Exam on the first attempt, Mr. Gunsberg was awarded a fellowship with Public Counsel where he advised staff attorneys about criminal justice issues. Mike Arias is the senior and managing partner of the firm. He handles matters throughout the United States.
